Crypto Tax in Ukraine in 2026: Should You Pay Now and What Will Bill 10225-d Change?

Crypto Tax in Ukraine Guides
The law on crypto taxes has been awaiting its second reading for more than a year, while banks are already asking about the origin of funds from exchanges. We explain which rules apply now, what draft law 10225-d proposes, and what you should do today.

In Brief

  • There is currently no special tax regime for cryptocurrency in Ukraine. The 2022 Law “On Virtual Assets” has still not entered into force, as it is awaiting amendments to the Tax Code.
  • These amendments are contained in draft law 10225-d. The Verkhovna Rada passed the first reading on September 3, 2025, while the second reading in July 2026 was postponed until autumn due to disagreements over the regulator.
  • The absence of a special regime does not mean “tax-free”: under the general rules, a resident’s income is taxed at 18% personal income tax and a 5% military levy.
  • The draft proposes taxing only profits when converting to fiat, exempting crypto-to-crypto exchanges, allowing loss carryforwards, and introducing a preferential 5% + 5% rate in the first year for previously purchased assets.
  • The main thing worth doing right now is reconstructing your purchase and sale history while exchanges still allow you to export statements.

“Do you have to pay tax on crypto?” is one of the most common questions among Ukrainian investors. The short answer is that the obligation to pay tax on income already exists, but the mechanism for cryptocurrency is not defined by law. Below is what applies today, what bill 10225-d proposes, and how to prepare for any scenario.

Current status of the bill

DateWhat happened
February 2022The Law “On Virtual Assets” (2074-IX) was adopted. It will enter into force only after amendments to the Tax Code
April 24, 2025Bill 10225-d on the taxation and regulation of virtual assets was registered
September 3, 2025The Rada passed it in the first reading (246 votes)
July 31, 2026Consideration in the second reading was postponed until autumn: there is no agreement on the division of powers between the NBU and the NSSMC
October 2026The bill is still being prepared for the second reading

Among the reasons for the delay, MP Olha Vasylevska-Smahliuk also cited doubts about having enough votes: according to her, many lawmakers themselves own crypto assets, Interfax-Ukraine reports.

What applies now

As long as there is no special regime, the general rules of the Tax Code apply:

  • income received by a tax resident of Ukraine is subject to 18% personal income tax and a 5% military levy;
  • the obligation to declare income does not depend on whether a separate law on crypto has been adopted;
  • the annual declaration of assets and income must be submitted by May 1 of the following year.

The problem lies in the mechanics. The law does not define what should be considered a taxable object in cryptocurrency, how to calculate the tax base, or how to confirm the purchase cost. Therefore, the position that “there is no tax” is incorrect, but it is also difficult at present to calculate the tax confidently using a specific formula. If you have substantial income from cryptocurrency, discuss declaring it with a tax advisor.

What Bill 10225-d proposes

ProvisionWhat is proposedComment
Taxable objectProfit from exchanging cryptocurrency into fiatExchanging one cryptocurrency for another is not taxed
Rate for individuals18% personal income tax + 5% military levyTax applies to profit, not to the entire withdrawal amount
LossesCarried forward to subsequent yearsReduce the future tax base
Preferential period5% personal income tax + 5% military levy in the first yearFor assets purchased before the law enters into force
Legal entitiesProfit is included in the overall financial result, corporate income tax 18%Simplified-tax-regime businesses are prohibited from working with cryptocurrency
VATTransactions with virtual assets are exemptExcept for the exchange of NFTs and tokens confirming rights to goods or services
ProvidersRegistration and annual reporting to the tax authoritiesExchanges will provide client data

Each line is a draft provision. In the second reading, the figures and timeframes may change, so treat them as a proposal rather than a tariff.

Example: how much you would pay under the bill

Suppose you bought Bitcoin for UAH 100,000, and after the law came into force, sold it for UAH 150,000 and withdrew the hryvnia to your card.

ScenarioProfitPersonal income taxMilitary levyTotal tax
Standard rateUAH 50,000UAH 9,000 (18%)UAH 2,500 (5%)UAH 11,500
Preferential first yearUAH 50,000UAH 2,500 (5%)UAH 2,500 (5%)UAH 5,000

The key condition for both scenarios is to confirm the purchase price. Without proof, the tax authority may treat the entire sale amount as income.

How to prepare for crypto tax: step by step

  1. Export your history from all exchanges. Binance, Bybit, WhiteBIT, and others allow you to download reports on trades, deposits, and withdrawals. Do this for each year while the accounts are active.
  2. Save your P2P transaction history. Order number, date, amount in hryvnias, counterparty. This is proof of the purchase and sale price.
  3. Record transfers between your own wallets. Transaction hashes show that you were moving your own coins rather than receiving income.
  4. Consolidate everything into one spreadsheet or calculator. Date, asset, quantity, price in hryvnias, fee. Crypto tax calculators can import exchange files.
  5. Separate fiat withdrawals from exchanges. Under the draft law, tax arises when withdrawing into fiat, so these transactions are the most important to document.
  6. Keep bank statements showing incoming P2P transfers. They will be needed both for the tax authorities and for the bank’s financial monitoring.
  7. Follow the second reading. When the law is adopted, you will have a ready basis for the calculation, including for the preferential period.

Taxes and the bank’s financial monitoring

Even without a special regime, banks can already see the movement of money between exchanges and cards. When a bank asks about the source of funds, your transaction history and proof of tax payment are the best arguments. We explained how to respond to such requests in the article PrivatBank Requested Proof of Source of Funds. To learn how to legally withdraw a large amount, read the separate guide.

If you live in the EU

Ukrainians who have become tax residents of an EU country pay tax under that country’s rules, not Ukrainian rules. Starting in 2026, under the DAC8 directive, exchanges will transmit data on EU residents’ transactions to tax authorities. What to specify on an exchange and how to determine tax residency is explained in the guide DAC8: the exchange requires a tax number.

Risks

  • The rules will change in the second reading. The rates, grace period, and taxable object may still change.
  • Documents cannot be created retroactively. The grace window is intended for those who can confirm the purchase date and price. Exchanges are shutting down, accounts are being blocked — export your history now.
  • Financial monitoring is not waiting for the law. Banks are already asking questions now, regardless of the bill’s status.
  • Do not pay at a rate that does not yet exist. The preferential 5% + 5% exists only in the draft.

FAQ

Is there currently a tax on cryptocurrency in Ukraine?

There is no special tax regime for cryptocurrency. However, under the general rules, the income of a tax resident of Ukraine is subject to 18% personal income tax and a 5% military levy, and the obligation to declare income applies regardless of a separate law.

When will Bill 10225-d be adopted?

There is no exact date. The bill passed its first reading on September 3, 2025. In July 2026, consideration in the second reading was postponed until autumn due to disagreements between the NBU and the NSSMC over the distribution of powers.

Will the exchange of one cryptocurrency for another be taxed?

Under the draft law — no. The tax is proposed to be levied only on profits when exchanging cryptocurrency for fiat money. An exchange, for example, of BTC for USDT is not subject to tax.

What is the preferential 5% rate for cryptocurrency?

This is a proposed provision of the bill: during the first year after the law takes effect, profit from the sale of assets purchased before its entry into force will be subject to 5% personal income tax and a 5% military levy instead of 18% and 5%. The provision may change during the second reading.

How can you confirm the purchase price of cryptocurrency?

With an exchange statement confirming the purchase, a P2P order history together with bank statements confirming payment, as well as transfer hashes between your own wallets. Export this data in advance while your exchange accounts are still accessible.

Do I need to pay tax in Ukraine if I live in the EU?

It depends on your tax residency. If you are a tax resident of an EU country, tax is paid according to that country’s rules. If you remain a resident of Ukraine, Ukrainian rules apply. Residency is determined by the length of stay and the center of vital interests.
